Terms and conditions

Last updated : 15 October 2026

The German version of the legal texts is authoritative; this English translation is provided for convenience. Allgemeine Geschäftsbedingungen

In short

  • Contract by written quote plus a 30 % deposit of the order value.
  • Free reschedule or cancel more than 5 days before the session; later rules in Article 7.
  • Mix/master includes 2 revision rounds; projects kept 24 months.
  • Austrian law applies; consumer withdrawal under distance-selling rules where relevant.

1. Scope and parties

These terms apply to services of Noelpulse GmbH, Stapelgasse 8, 1050 Wien («we», «studio»), brand Noelpulse, for customers («you»). They complement your quote, order confirmation, and descriptions on Services and on Vocal recording, Mixing, Mastering, Podcast production, and Rehearsal recording.

Different terms apply only if we confirm them in writing. Consumers are natural persons acting mainly outside their trade; all other clients are businesses. Legal notice: Legal notice. Privacy: Privacy policy; processing agreement: DPA.

2. Definitions

TermMeaning
QuoteWritten summary of price, scope, date, VAT, and deposit.
SessionReserved studio time with engineer support as described in the quote.
Distance contractContract concluded without simultaneous physical presence (email, form, phone).
Business dayMonday to Friday, excluding public holidays in Vienna.
Deposit30 % of the agreed gross price to hold the date.
File archiveProject storage as in Article 12.

3. Pre-contract information

Before booking we provide main features of the service, total price including 20 % VAT, payment and delivery timing, our identity and contact details, and withdrawal information where applicable — via the site, FAQ, and your quote. Guide prices (e.g. €240 for Rehearsal recording) are non-binding until fixed in the quote.

4. Quote, acceptance, and deposit

We handle requests through Contact, +43 1 546 78 90, or [email protected] within about 2 business days. Quotes state an expiry date; if none is given, they stay valid for four weeks from issue. A date is firm once you accept in writing (email is enough) and pay the 30 % deposit by bank transfer or agreed in-studio card payment.

Until the deposit arrives, the slot may be offered to someone else. For distance contracts we send confirmation by email with the main terms.

5. Prices and extras

Accepted quotes are in euros and include statutory VAT unless marked net. Net prices for businesses are increased by 20 % VAT.

Extra studio time is billed only with your prior consent, in 30-minute steps at the quoted hourly rate (e.g. €85). Add-ons such as stems, alternate masters, or express delivery need written agreement.

6. Payment

The deposit counts toward the balance. Consumers pay the remainder on the service day or before release of final files for remote work. Businesses receive 14 days from the invoice date; late payment triggers statutory default interest for B2B.

We may withhold final exports until full payment; working files follow the archive rules in Article 12. Set-off is excluded unless your counterclaim is undisputed or final.

7. Reschedule and cancellation by you

Notice before sessionEffect
More than 5 daysFree move or cancel; deposit refunded within 14 days if you cancel.
5 days to 72 hoursOne reschedule within 3 months; otherwise deposit is retained.
Under 72 hours or no-showDeposit retained unless force majeure applies.

Please email [email protected]; we confirm phone changes in writing. Late arrival shortens the session without extension if the next slot is booked. Statutory consumer rights remain unaffected.

8. Consumer withdrawal

Consumers who conclude a distance or off-premises contract may withdraw within 14 days of conclusion unless an exception applies (fully performed service with express consent before the deadline, fixed-date session, etc.).

Send a clear statement to [email protected] or by post to Noelpulse GmbH, Stapelgasse 8, 1050 Wien. We refund payments within 14 days; if work started at your request, a proportionate amount may be due.

Model withdrawal form

To Noelpulse GmbH, Stapelgasse 8, 1050 Wien, [email protected]:

I hereby withdraw from my contract for the following service:

  • Ordered on:
  • Name:
  • Address:
  • Date:
  • Signature (paper only):

9. Cancellation by us

If we must cancel due to major equipment failure, engineer illness, or official order, we notify you promptly and offer a replacement date. If no reasonable alternative suits you, we refund all payments within 14 days. We change the assigned engineer only with your consent.

10. Studio conduct

Hours: Mon–Fri 10–19, Sat by appointment; sessions by appointment. Rooms fit the headcount in your quote. Minimum age to book alone: 16; younger participants need written guardian consent and supervision on site.

Treat gear and rooms carefully, follow engineer safety instructions, and do not smoke indoors. We may pause a session if people or equipment are at risk; continued misuse can lead to termination without refund where you are at fault. Gear you bring stays your responsibility.

We offer hearing protection and moderate levels. Preparation tips are in our Guides, e.g. Prepare vocals for the studio.

11. Copyright and your warranties

You confirm rights to lyrics, samples, covers, and performer contributions, and handle collecting-society filings yourself. We claim no rights in your works.

Who initiates and funds the recording is generally the phonogram producer; that is you when you order and pay. To the extent permitted, we assign any studio participation rights once paid in full. Composition or production commissions need separate written terms.

We do not use your recordings to train AI or clone voices without specific written consent. We name you as a reference only with written approval.

12. Files, delivery, and archive

Unless agreed otherwise, we deliver 24-bit WAV by download link or your media. Mix and master timelines start when complete usable material arrives — see Plan mix budget and Mastering formats.

We keep project data 24 months after the last edit, then delete unless a longer period was agreed. You remain responsible for backups. Extended storage can be quoted separately.

13. Revisions

Post-production includes 2 revision rounds unless the quote says otherwise. One round means one consolidated written note list handled in a single pass. Further rounds or a new direction after approval are re-quoted.

14. Liability

We work with professional studio care; artistic outcome also depends on your preparation and source material. Claims for damages are excluded for slight negligence except personal injury, fraud, or mandatory liability.

For business clients, financial loss from slight negligence is capped at the foreseeable damage and at most the gross price of the affected order. Indirect loss is excluded where law allows. Website content limits: Disclaimer.

15. Warranty

Consumers have statutory remedies if delivered files are defective or not as agreed (format, length, version). Report issues promptly; we offer correction or re-delivery. Business contracts follow Austrian rules on contracts for work unless the quote states otherwise.

16. Privacy and the contact form

We process personal data under our Privacy policy. If you send third-party data (guests, musicians), ensure they are informed; business clients use our DPA.

The Contact form uses FormSubmit (United States) to forward messages to [email protected]. Legal bases and safeguards are in the privacy policy; you may also reach us by +43 1 546 78 90 or post.

17. Force majeure

Neither party is liable for delay or failure caused by unforeseeable events beyond reasonable control (official closure, power failure, pandemic measures). The affected party informs the other without delay. Sessions move to new dates; if disruption lasts more than 28 days, either party may withdraw and receive refunds for unperformed services.

18. Final provisions

Austrian substantive law applies, excluding CISG and conflict rules. Courts in Vienna have jurisdiction for business disputes. Consumers may sue at home where mandatory rules say so.

If a clause is invalid, the rest remains; a valid clause closest to the intent replaces it. Changes apply to new orders from 15 October 2026; ongoing jobs keep the version accepted at booking. The German text prevails over this translation. Questions: [email protected] or Contact.
